1. Introduction

These Terms & Conditions (“Terms”) govern your use of our website and any purchases you make from us. By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

2. About Our Items

We specialize in rare books, manuscripts, maps, photographs, and related historical artifacts. Given the nature of antiquarian and collectible material:

• Each item we offer is described to the best of our knowledge and expertise, based on physical examination, provenance research, and industry-standard bibliographic references.
• Condition, rarity, and authenticity descriptions reflect our professional judgment at the time of listing. Where relevant, we note restoration, repairs, or condition issues.
• Photographs are provided to supplement, not replace, written condition descriptions. Colors and details may vary slightly due to photography and screen display.
• Unless otherwise stated, items are sold as antiquarian/collectible goods and may show signs of age, handling, or prior ownership consistent with their age and history.

3. Descriptions, Authenticity, and Grading

• We follow standard antiquarian bookselling conventions (such as those of the ABAA/ILAB) in describing condition and rarity.
• Any attribution of signatures, inscriptions, or association copies reflects our best professional assessment based on available research, comparanda, and provenance documentation. We are happy to share the basis for such attributions upon request.
• If we state that an item includes a formal authentication, appraisal, or certificate of authenticity, a copy will be provided with the item.
• We do not guarantee against attribution disputes that may arise from new scholarship or subsequently discovered information, though we stand behind the accuracy of our descriptions as understood at the time of sale.

4. Pricing and Payment

• All prices are listed in U.S. Dollars unless otherwise indicated, and are subject to change without notice until an order is completed.
• Payment is due in full at the time of purchase unless other arrangements (such as a deposit, layaway, or invoicing terms) have been agreed to in writing.
• We accept  major credit cards, PayPal, wire transfer & personal checks.
• Sales tax will be applied where required by law.
• We reserve the right to refuse or cancel an order for any reason, including pricing errors, suspected fraud, or item unavailability, with a full refund issued in such cases.

5. Shipping and Handling

• Items are carefully packed to preserve their condition during transit. Rare and fragile items may require custom packaging.
• Shipping costs, carriers, and insurance are as specified at checkout or in individual item listings.
• Risk of loss and title for items pass to the buyer upon our delivery to the shipping carrier, unless otherwise required by law.
• International buyers are responsible for any customs duties, import taxes, or fees imposed by their country. We are not responsible for delays caused by customs processing.
• High-value items may require signature confirmation and/or additional insurance at the buyer’s expense.

6. Returns and Approval

• Items may be returned within two (2) business days of receipt if the item is materially not as described, provided the item is returned in the same condition in which it was sent.
• Buyers must contact us within two (2) business days of receipt to initiate a return or report a discrepancy.
• Returns due to buyer’s change of mind may be subject to a restocking fee or may not be accepted, at our discretion, particularly for items sold on approval or by special arrangement.
• Custom orders, items sold “as-is” with disclosed flaws, or items explicitly marked as final sale are not eligible for return unless required by law.
• Refunds will be issued to the original payment method once the returned item is received and inspected.

7. Layaway and Deposits

If we offer layaway or deposit arrangements:

• Terms (deposit amount, payment schedule, and forfeiture conditions) will be agreed to in writing at the time of the arrangement.
• Deposits are generally non-refundable if the buyer fails to complete payment per the agreed schedule, except as required by law.

8. Intellectual Property

• All content on the Site, including photographs, descriptions, catalog text, and design elements, is the property of Colorado Artifactual unless otherwise credited, and may not be reproduced without our written permission.
• Purchase of a physical item does not transfer any copyright or intellectual property rights in the underlying work unless explicitly stated.

9. Limitation of Liability

• To the fullest extent permitted by law, Colorado Artifactual shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Site or purchase of an item.
• Our total liability for any claim relating to a purchase shall not exceed the amount paid for the item in question.
• Nothing in these Terms limits any liability that cannot be limited under applicable law.

10. Appraisals and Valuations

Any valuations, appraisals, or price opinions provided by us are for informational purposes only, reflect our professional opinion at a given time, and should not be relied upon for insurance, estate, tax, or legal purposes without an independent formal appraisal.

11. Privacy

12. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Gunnison County, Colorado.

13. Changes to These Terms

We may update these Terms from time to time. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms. The “Last Updated” date at the top of this page reflects the most recent revision.
